SurvStash Terms and Conditions

Effective Date: 11.10.2014.

 

1. Introduction

Welcome to SurvStash, owned and operated by Desalle d.o.o. These Terms and Conditions ("Terms") govern your use of the SurvStash mobile and web applications (collectively, the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms.

 

2. Definitions

  • "Subscriber" refers to any individual who registers for and uses the SurvStash Service.
  • "Service" means the SurvStash mobile and web applications and all related services provided by Desalle d.o.o.
  • "Stash" refers to the collection of disaster supplies accumulated through subscription Levels.
  • "Level" indicates the tier of the Stash a Subscriber has achieved.
  • "Bonus Points" are points earned by Subscribers that can be redeemed for extra Levels.

 

3. Subscription Plans and Stash Levels

3.1. Subscription Plans

SurvStash offers three subscription plans:

  • Basic Plan
    • Gain 1 Level every 2 months
  • Advanced Plan
    • Gain 1 Level every month
  • Expert Plan
    • Gain 2 Levels every month

3.2. Stash Levels and Content

  • Each Level unlocks a distinct quantity and variety of disaster supplies.
  • Supplies are grouped into categories:
    • Food
    • First Aid
    • Hygiene
    • Survival Gadgets
  • Higher Levels provide access to more valuable and diverse items.
  • Items within each category are predetermined and cannot be individually selected.

3.3. Bonus Points and Extra Levels

  • Bonus Points: Earned through specific activities within the Service.
  • Every 100 Bonus Points grants 1 extra Level.
  • Redemption of Extra Levels:
    • Bonus Levels can be redeemed after 12 months of continuous subscription.
    • Redemption is subject to the terms outlined in Section 5 (Delivery of Stash).

3.4. Modifications to Levels and Content

  • SurvStash reserves the right to modify Levels, categories, or associated items to enhance the Service or respond to market conditions.
  • Subscribers will be notified of significant changes as outlined in Section 7.

 

4. Payment and Billing

4.1. Subscription Fees

  • Subscribers agree to pay the monthly subscription fee associated with their chosen plan.
  • Payments are made in advance of accessing new Levels.
  • By subscribing or making one-time payments, you acknowledge that you are making advance payments for the provision of survival stash items.
  • Advance payments are non-refundable, as they grant immediate access to subscription benefits.

4.2. In-App Purchases

  • Subscribers may make a one-time payment to instantly increase their Level by 1, 2, 3, or 4 Levels.
  • The cost of the one-time payment is calculated based on the monthly fee of the Advanced Plan multiplied by the number of Levels purchased.
  • One-time payments are non-refundable and considered immediate service enhancements.
  • Upon successful payment, the Subscriber's Level will be instantly increased by the number of Levels purchased, providing access to the benefits associated with the upgraded Level.

4.3. Payment Failure

  • Failure to make timely payments results in the suspension of gaining further Levels.
  • If a Subscriber misses payments for two consecutive months, their Level will be reset to 0.
  • Advance payments made will not be refunded if delivery cannot be completed due to circumstances outlined in these Terms.

4.4. Refund Policy

  • SurvStash does not offer monetary refunds for:
    • Partial subscription periods
    • Cancellations
  • By subscribing, you acknowledge and agree to this refund policy.

 

5. Delivery of Stash

5.1. Initiating Delivery

  • To access your Stash, you must initiate a delivery request through the SurvStash app.

5.2. Delivery Timeline

  • SurvStash will make the Stash available for delivery within 14 days of the request.

5.3. Delivery Methods

  • The delivery method is determined by your Level:
    • Level 1: Self-pickup
    • Level 5 and above: Premium courier service

5.4. Responsibility

  • You are responsible for ensuring that delivery can be successfully completed according to these Terms.
  • Failure to initiate delivery within the specified timeframes may result in loss of access to your Stash.

5.5. Limitation of Liability for Physical Products

  • SurvStash is not liable for any damages or losses resulting from the use of the physical products delivered.
  • Products are provided "as is" without warranties of any kind.

 

6. Cancellation and Termination

6.1. Cancellation Policy

  • You may cancel your subscription at any time via:
    • The SurvStash app (select "Change" > "Cancel Subscription")
    • The SurvStash website
  • After cancellation:
    • You have a 2-month period to request delivery of your Stash.
    • Failure to request delivery within this period results in the Level being reset to 0, and access to the Stash is lost.
  • Advance payments are non-refundable, and cancellation does not entitle you to any refund.
  • By cancelling, you acknowledge and agree to this policy.

6.2. Account Deletion

  • You can delete your account through the app's "Profile" menu by selecting "Delete Account."
  • This action permanently deletes the account, cancels the subscription, and resets the Level to 0.
  • Advance payments made up to the point of account deletion are non-refundable.

6.3. Effects of Termination

  • Upon termination, your rights to use the Service cease immediately.
  • Obligations accrued prior to termination, such as outstanding payments, remain in effect.

6.4. Termination by SurvStash

  • SurvStash reserves the right to terminate access for:
    • Violation of these Terms
    • Fraudulent activity
    • Any other breach of contract

 

7. Notifications and Communications

7.1. Updates and Modifications

  • Subscribers will receive timely notifications about:
    • Changes to Levels, categories, or items
    • Advancements in upcoming Levels
    • Modifications to these Terms

7.2. Communication Methods

  • Notifications will be provided through:
    • Home screen messages within the app
    • Pop-up messages within the app
    • The News section within the app
  • No notifications will be sent via email.
  • It is your responsibility to regularly check the app for updates.

7.3. News Section

  • The app features a News section providing:
    • Articles
    • Important updates related to subscriptions
  • While we strive for accuracy, refer to these Terms for precise details.

 

8. User Conduct

  • You agree not to misuse the Service. Prohibited activities include, but are not limited to:
    • Engaging in illegal activities
    • Attempting to hack or disrupt the Service
    • Transmitting harmful or objectionable content
  • Violation of this clause may result in termination of your account.

 

9. User Requirements

9.1. Age Restriction

  • You must be at least 18 years of age to use the Service.
  • SurvStash may request verification of age.

9.2. Account Security

  • You are responsible for:
    • Maintaining accurate contact information
    • Safeguarding account credentials
    • Ensuring individuals under 18 do not access the account

9.3. Compliance with Laws

  • You agree to comply with all applicable laws and regulations when using the Service.

 

10. Privacy and Data Security

  • SurvStash collects user data to provide and improve the Service.
  • Our Privacy Policy, available within the app and at https://info.survstash.com/en/terms-and-conditions, details:
    • Types of data collected
    • Usage of data
    • User rights regarding their information
  • SurvStash is committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR).

 

11. App Permissions and Access

  • By using SurvStash, you grant necessary permissions for app functionality, which may include access to:
    • Device storage
    • Camera
    • Location
  • The app accesses only information required for its features.
  • You can manage permissions in your device settings.

 

12. Intellectual Property

12.1. Ownership

  • All intellectual property, including the app, logos, trademarks, and software, is the exclusive property of Desalle d.o.o. unless otherwise stated.

12.2. Restrictions

  • Unauthorized use, reproduction, or distribution is prohibited and may result in termination and legal action.

12.3. User Feedback

  • By providing feedback, you grant Desalle d.o.o. the right to use and implement suggestions without obligation or compensation.

 

13. Indemnification

  • You agree to indemnify and hold Desalle d.o.o. and its affiliates harmless from any claims arising from:
    • Violation of these Terms
    • Violation of laws or regulations
    • Infringement of third-party rights
  • Desalle d.o.o. will provide prompt notice of any such claims and reserves the right to assume defense.

 

14. Limitation of Liability

  • Desalle d.o.o. is not liable for:
    • Indirect, incidental, or consequential damages
    • Loss of profits, data, or goodwill
  • The total liability is limited to the amount paid by you in the two months preceding the event causing the liability.
  • This limitation applies to the fullest extent permitted by law.

 

15. Force Majeure

  • Desalle d.o.o. is not liable for failure or delay in performance due to events beyond reasonable control ("Force Majeure Events"), such as:
    • Natural disasters
    • War or terrorism
    • Power outages
  • Obligations are suspended for the duration of the Force Majeure Event.
  • You will be notified of any such events through appropriate channels within the app.

 

16. Modification of Terms

  • Desalle d.o.o. reserves the right to modify these Terms at any time.
  • You will be notified of changes at least 7 days before they take effect, via:
    • Home screen messages
    • Pop-up messages within the app
    • The News section within the app
  • Continued use after the effective date constitutes acceptance of the new Terms.
  • If you disagree with the modifications, you may terminate your subscription as per Section 6.

 

17. Severability

  • If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in effect.

 

18. No Waiver

  • Failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

 

19. Governing Law and Dispute Resolution

19.1. Governing Law

  • These Terms are governed by the laws of the European Union (EU).

19.2. Dispute Resolution

  • Any disputes arising out of or relating to these Terms shall be resolved through negotiation in good faith.
  • If a resolution is not reached, disputes will be submitted to the competent courts in the EU jurisdiction.

21. Entire Agreement

  • These Terms constitute the entire agreement between you and Desalle d.o.o. regarding the use of the Service.

  • Section titles are for convenience only and do not affect the interpretation of these Terms.

 

23. Language

  • These Terms and Conditions are provided in English. If translated into other languages, the English version shall prevail in case of discrepancies.

 

By using the SurvStash app, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
